Potens Machinery Inc Limited Warranty Policy

1. STANDARD LIMITED WARRANTY
Potens Machinery Inc (located in Texas, USA), hereinafter referred to as the “Seller,” warrants to the original purchaser and end-user (the “Buyer”) that its products, services and associated parts (the “Products”) shall be free from defects in materials and workmanship under normal, proper use and service.
Warranty Period: The warranty period for all standard products is Twelve (12) months from the date of original purchase.
If a Product is determined to be defective within the Warranty Period, the Seller will, at its sole discretion, repair, replace, or refund the purchase price of the defective Product. Any repaired or replaced Products shall remain subject to the balance of the original Warranty Period.
2. WARRANTY EXCLUSIONS & LIMITATIONS
This Limited Warranty strictly covers manufacturing defects and does not cover damages, failures, or defects resulting from the following:
Improper Maintenance: All equipment maintenance must be performed strictly as outlined in the provided operating manuals, utilizing the specified tools, lubricants, and materials. Operating the unit without proper upkeep or failing to adhere to the manufacturer-recommended routine maintenance schedule will immediately void this warranty.
Misuse & Overloading: This warranty shall be void if the machine or its associated tools are operated beyond their documented capacity. Furthermore, the processing of material types, thicknesses, or gauges not explicitly approved in the manufacturer's manuals and technical documentation constitutes misuse and will immediately invalidate all warranty coverage.
Improper Installation: All equipment installations must be performed in strict accordance with the manufacturer's manuals and official technical documentation. Any deviation from these approved procedures constitutes misuse and will immediately invalidate all warranty coverage.
Unauthorized Alteration: Any Product for which the warranty sticker has been removed, or which has been dismantled, modified, or repaired by anyone other than an authorized Potens Machinery Inc service representative.
Environmental Damage: Corrosion, water intrusion, or damage resulting from improper storage after the Product has left our warehouse.
Normal Wear and Tear: Routine degradation of consumable components such as oil seals, O-rings, and bearings after prolonged use.
Acts of God: Casualties, accidents, natural disasters, or other external causes beyond the control of the Seller.
3. PROCEDURE FOR WARRANTY CLAIMS
Please Note: As a general policy, Potens Machinery Inc. does not accept returns for refunds. Our warranty coverage is primarily dedicated to the repair, servicing, or replacement of defective parts and equipment. However, in exceptional circumstances, returns may be accepted strictly on a case-by-case basis and at the sole discretion of Potens Machinery Inc.
To ensure a smooth and efficient warranty evaluation, the Buyer must adhere to the following steps:
Initial Assessment & Authorization: Prior to shipping any equipment or parts to us for repair or special return, the Buyer must contact Potens Machinery Inc. customer service. Due to the size and weight of our machinery, our technicians will often require photos or videos to conduct an initial remote assessment. If a physical repair or authorized return is deemed necessary, we will issue a Return/Service Authorization (RMA/SA) number. No freight deliveries or shipments will be accepted at our facility without an approved authorization number.
Provide Documentation: The Buyer must supply a clear and correct copy of the original purchase receipt, the equipment’s serial number, and a detailed written description of the failure or operational issue.
Shipping: The Buyer is responsible for prepaying all initial freight and shipping charges to send the defective part or equipment to our designated facility. If Potens Machinery determines that the failure is covered under this Limited Warranty and the item is to be repaired, we will service the item and cover the cost of return ground shipping back to the Buyer (to any address within the continental United States). (Note: Customers in Canada or outside the continental U.S. may be responsible for additional cross-border freight or customs fees).
4. DISCLAIMER OF IMPLIED WARRANTIES & LIMITATION OF LIABILITY
EXCEPT AS EXPRESSLY SET FORTH ABOVE, ALL PRODUCTS ARE PROVIDED ON AN "AS IS" BASIS. POTENS MACHINERY INC MAKES NO ADDITIONAL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
LIMITATION OF LIABILITY: Under no circumstances shall Potens Machinery Inc be held liable for any loss of use, interruption of business, lost profits, downtime, or any indirect, special, incidental, punitive, or consequential damages of any kind, regardless of the form of action (whether in contract, tort, strict liability, or otherwise), even if the Seller has been advised of the possibility of such damages. In no event shall the total liability of the Seller hereunder exceed the original purchase price paid for the specific Product giving rise to such liability.
5. CHOICE OF LAW AND JURISDICTION
This Limited Warranty shall be governed by and construed in accordance with the laws of the State of Texas, USA. Any legal disputes arising hereunder shall be subject to the exclusive jurisdiction of the state and federal courts located in Texas. The parties hereby consent to the personal jurisdiction of such courts.
